Fragstats 5 End user license

Effective Date: November 2025

IMPORTANT: INSTALLING OR USING THE SOFTWARE CONFIRMS ACCEPTANCE OF THESE TERMS. IF YOU DISAGREE, DO NOT USE THE SOFTWARE.

1. Parties

This License Agreement ("Agreement") is between:

  • Licensor: Authors Kevin McGarigal and Eduard Ene (collectively, "Authors"), holders of all copyrights.
  • Distributor: eco-logica software solutions inc. ("Corporation"), with invoices issued exclusively by eco-logica software solutions inc. with Paddle.com as Merchant of Record.
  • Licensee: The individual or entity installing or using the Software.

2. Grant of License

Subject to compliance with this Agreement, the Authors grant Licensee a non-exclusive, non-transferable, revocable license to use the Software solely:

  • On one (1) computer at any given time
  • With allowance for multiple concurrent sessions on the same computer if workload demands

3. Copyright & Ownership

  • The Software, including code, documentation, and design, is copyrighted property of Authors Kevin Mcgarigal and Eduard Ene.
  • Ancillary Libraries: Third-party libraries retain their original copyrights and licenses. Licensee agrees to comply with all such licenses.

4. Restrictions

Licensee shall not:

  • Copy, modify, reverse-engineer, or distribute the Software without written consent
  • Use the Software beyond the scope of the granted license
  • Transfer the license to another party

5. Academic Use

  • Free Academic License: Eligible academic institutions/instructors may use the Software at no cost if:
    • They register via the Fragstats academic program (log in for more instructions)
    • eco-logica software solution inc. approves the application and issues an academic license
    • Use is limited to classroom instruction or non-commercial research
  • Unregistered academic use is prohibited

6. Term & Renewal

  • Term: All licenses expire one (1) year from issuance
  • Renewal:
    • Paid licenses: Renewal requires payment of applicable fees
    • Academic licenses: Renewal requires re-application to the Fragstats academic program
  • Failure to renew terminates all rights immediately

7. Payment & Invoicing

  • All fees payable to eco-logica software solution inc.
  • Invoices will reflect eco-logica software solution inc. as the seller
  • Academic licenses are fee-exempt post-approval

8. Warranty & Liability

  • Stability: The Software has a documented history of reliable use in academic, governmental, and consulting environments
  • No Warranty: Provided "AS IS" without warranties of performance or fitness
  • Liability Cap: Authors / distributor's liability is limited to refunding the purchase price. If unenforceable in Licensee's jurisdiction, Licensee is prohibited from using the Software

9. Updates & Modifications

eco-logica software solution inc. may update this Agreement periodically.
Revised terms will be posted at: https://www.fragstats.org/index.php/license. Continued use constitutes acceptance.

10. Termination

  • Automatic termination upon breach of key sections
  • Upon termination, Licensee must destroy all copies of the Software

11. Governing Law & Disputes

Governed by the laws of Ontario, Canada. Disputes resolved exclusively in courts of Ontario, Canada.

12. Entire Agreement

This Agreement supersedes all prior agreements. Amendments require written consent from Corporation.

INSTALLING OR USING THE SOFTWARE CONFIRMS ACCEPTANCE OF THESE TERMS.
